Article 1: Application of these terms and conditions of sale
All orders for products distributed through the sites www.territoirewhisky.fr (www.landofwhisky.com) or www.terredechampagne.fr (www.landofchampagne.com) implies acceptance and full compliance with the present general conditions of sale, including price, volumes and quantities offered to sale. These sales are carried out legally by the SAS Land of Legend, RCS 499633410 Besancon (France). These terms of sale (GCS) cancel any differently or contrary clause, appearing on documents or correspondence from the customer. These GTC are governed by the french law . Courts in the headquarters of the SAS Land of Legend (TDL below) have exclusive France jurisdiction (Besancon).
Article 2: Ordering
The customer places an order by clicking on "validate the purchase."
Any order is known as final with reception of the payment of the purchaser.
All our offers get along within the limit of stocks available, without engagement and except sale meanwhile.
Restrictions relating to the quantities available can being under consideration within sight of the rare or speculative character of certain products.
Some offers, particularly promotions, are limited to one per household sale, it means the same name, same address, same account or credit card.
If TDL would not be able to deliver the goods ordered, it offers the buyer a substitute product of equal value or refund within fifteen to thirty days, at the discretion of the customer.
At the time of the order taking, all the information transmitted by the purchaser engages only this one. In the event of error or of omission in the transmission of information (name, addresses...) TDL could not be held responsible for the impossibility in which it could then be to deliver the order.
Our offers are reserved to the customers of the private individuals. However, the professional retailers can profit from preferential conditions on certain products. Article 3: Terms of price and delivery
The price of the whiskies, champagnes, other drinks and accessories gets along in euro, all inclusive of tax and except forwarding costs, those remaining due for the delivery and payable in euro also, and valid in Metropolitan France (Corsica included) [ applicable VAT, applicable excises and all other taxes ]. The prices are indicated subject to typographical errors or of posting.
For the countries of the European Community, excluded France, the sendings are limited to 60 bottles standards maximum.
TDL remains owner of the products until the complete payment of the price of the products (law n°80-335 of the 12/05/1980).
The prices remain modifiable constantly without notice, knowing that the products will be invoicees on the basis of tariff in force at the time of the placing of order by the customer. However the purchaser is responsible for the articles ordered and this as of the delivery, the transfer of possession being worth transfer of risk.
The purchases can beings regulated by bank card directly on the site via a made safe payment, like by cheque, transfer or mandate. An invoice will be established with the bill-to-address and will be sent by courriel to the customer.

Article 4: Litigations and faculty of retractation
In France, each customer has a seven days deadline frank to retract as from the reception of the order or in the event of absence at the date of provision indicated by the conveyor. There is no reason to give nor penalties to be paid; Only the responsibility of the purchaser the expenses of references of the goods will be.
Wishing ardently that our products give you whole satisfaction, those will not be able however to us beings turned over that if they are strictly just and in their complete packing of origin, in the seven days which follow the reception of your order (in France). No customer will be able to prevail himself of this right if the ordered products are by their nature likely to worsen or of périmer quickly.
The possible delays do not give the right to the purchaser to cancel the sale or to refuse the goods, nor to claim damage interests, the delivery periods varying in particular according to the place of delivery.
It is up to the purchaser to check the contents of the parcel and to express reservations precise and justified on the delivery form, or to call without delay the customer service of the conveyor in the presence of the deliveryman. It also rests to the purchaser to inform TDL by letter registered addressed to its registered office or by courriel to the address contact@terredelegende.fr in the 72 hours which will be ensured near the conveyor of the reserves related to the delivery order. The compensation will be made in accordance with the general conditions sales of the conveyor.
TDL could not be held responsible for a non conforming use or diversion of products sold on its sites.
In any event, the parts begin to seek in priority a friendly solution preliminary to any action at law.
Article 5 : Limitation of guarantee and responsibility
Our products can being subjected to variations of aspects, weight... following the imponderable ones (in particular the action of the temperature). Thus no guarantee can be given in relation to the taste or the appearance of the products. Our products are healthy and consumable at the time of their handing-over to the conveyors. Our warehouses profit from conditions of storages adapted to the good conservation of the products. We recommend to store the products in a dry and healthy place, safe from the light, sun, gel and rain and without abrupt variation in temperature.
Are in particular regarded as case of absolute necessity - and without this list being restrictive - discharging TDL from any responsibility for delivery : the war, the riot, the fire, strikes and lockout, accidents as well as impossibility of being supplied.
Article 6: Legal Information
Under the terms of the data-processing legislation and freedom (law 78-17 of January 6, 1978), each Net surfer can have access and modify personal information relating to it by contacting us with courriel with : contact@terredelegende.fr. Our sites are recorded with the CNIL under number 1251403.
The information collected on the site is intended for TDL.
Under the terms of the ordinance n°59-107 of January 7 1959 which stipulates the prohibition of the sale of alcohol to the minors of less than 16 years and in accordance with the law n° 74-631 of July 5, 1974, the purchaser engages by filling the purchase order to be eighteen years old completed at the date of the order, TDL which cannot in no case to authorize the sale of alcohol to the minors.
The alcohol abuse is dangerous for health. To consume with moderation. The pregnant women or who nurse should not consume alcohol during their pregnancy, even in small quantity.
